Specifies the GDPR and the BDSG for public sector bodies of the State of NRW. Companies in the private sector are governed solely by the GDPR and the BDSG.

Cologne and the Rhineland are an insurance and media hub. Both bring their own privacy profiles: insurers (AXA, DEVK, Generali and Gothaer have locations in and around Cologne) process particularly sensitive health and contract data, which raises the requirements for technical and organizational measures. The LDI North Rhine-Westphalia is the supervisory authority for all non-public bodies headquartered in NRW. For cross-state corporate groups, the country-of-establishment principle under Art. 56 GDPR applies, with the main establishment in the EU being decisive. For public sector bodies of the State of NRW, the DSG NRW additionally applies.
Insurers need DPOs with knowledge of § 26 BDSG (employee data), Art. 9 GDPR (special categories such as health), VAG requirements and ideally experience with BaFin requirements for IT security. Kopexa partner DPOs are placed based on these specializations.
